Social Media Contest and Sweepstakes Rules

Participation Rules

These rules (“Official Rules”) govern when you (“Entrant”) participate in any Social Media Contest or Sweepstakes appearing on the Verified Official Dunn Tire X (formerly known as Twitter) Page, Facebook Page (“Dunn Tire Facebook Page”), Instagram Page (“Dunn Tire Instagram Page”), YouTube Page (“Dunn Tire YouTube Page”), and LinkedIn Page (“Dunn Tire LinkedIn Page”) (collectively, “Verified Official Dunn Tire Pages”). By participating in any Social Media Contest or Sweepstakes, Entrant agrees to these Official Rules issued by The Reinalt-Thomas Corporation, d/b/a Dunn Tire. Amendments to the Official Rules may be made from time to time and posted at this URL and will be effective when posted. Entrant’s continued participation in any Social Media Contest or Sweepstakes after the amendments are posted constitutes Entrant’s agreement to those amendments. Dunn Tire is not responsible for Contests or Sweepstakes on pages other than the Verified Official Dunn Tire Pages. Eligibility

Dunn Tire Social Media Contests and Sweepstakes (“Contests and Sweepstakes”) are open to legal residents of the United States who are 18 years of age or have reached the age of majority in their jurisdictions of residence, at the time of entry. Void in U.S. territories, possessions, commonwealths, military installations outside the continental United States, and where prohibited by law. Employees and agents of Dunn Tire, X (formerly known as Twitter), Facebook, Inc., YouTube, LinkedIn Corporation, their respective affiliates, subsidiaries, advertising and promotional agencies, any other Prize sponsor, any entity involved in the development, production, implementation, administration, or fulfillment of the Contest or Sweepstakes, and the immediate family members and persons living in the same household, whether related or not, are not eligible to participate or win.

No Purchase Necessary

No purchase is necessary to participate in any Contests or Sweepstakes.

How To Enter

X (Formerly Known as Twitter)

Eligible Entrants must first be a “Follower” of or “Follow” the Dunn Tire X (formerly known as Twitter) Page. The Entrant must then “Re-Tweet” the exact Contest or Sweepstakes verbiage originally posted by the Dunn Tire X (formerly known as Twitter) Page. Changing, adding, or deleting any verbiage from the original Dunn Tire tweet may disqualify the Entrant from winning. Multiple entries in the same calendar day will not be accepted. All entries must include “#contest” or “#sweepstakes”. Entries must be received by the date indicated on the initial Tweet by Dunn Tire. X (formerly known as Twitter) is not a sponsor of or affiliated with this Contest or Sweepstakes nor does it provide an endorsement of this Contest or Sweepstakes.

Facebook, Instagram

Eligible Entrants must Comment or Like a Post specific to a Facebook or Instagram Contest or Sweepstakes on the Dunn Tire Facebook Page or Dunn Tire Instagram Page. All entries must include “#contest” or “#sweepstakes”. Entries must be received by the date indicated on the initial post. Facebook and Instagram are not a sponsor of or affiliated with this Contest or Sweepstakes nor does it provide an endorsement of this Contest or Sweepstakes.

YouTube

Eligible Entrants must respond in the manner described in the Dunn Tire video or video description announcing the Contest or Sweepstakes. Any response that do not comply with the YouTube Community Guidelines (https://www.youtube.com/yt/about/policies/#community-guidelines) will be disqualified. YouTube is not a sponsor of or affiliated with this Contest or Sweepstakes nor does it provide an endorsement of this Contest or Sweepstakes.

LinkedIn

Eligible Entrants must respond in the manner described in the Dunn Tire post announcing the Contest or Sweepstakes. LinkedIn is not a sponsor of or affiliated with this Contest or Sweepstakes nor does it provide an endorsement of this Contest or Sweepstakes.

Enter By Mail

To enter by mail, send your name, address, telephone number, and email address to Dunn Tire, Attention Contests and Sweepstakes, 20225 N Scottsdale Ave., Scottsdale, AZ 85255. Entries must be received by the deadline outlined in the Contest or Sweepstakes announcement. Please indicate the Contest or Sweepstakes that you are entering. P.O. Boxes are not acceptable and will disqualify the Entrant if an alternative mailing address is not provided.

Conduct

By entering the Contest or Sweepstakes, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Contest or Sweepstakes. Entrants further agree to comply with and be bound by the selection of the Winner(s), which will be final and binding in all respects. Dunn Tire reserves the right in its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or Sweepstakes or any Dunn Tire Verified Official Dunn Tire Page or website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use, and/or general rules or guidelines of any Dunn Tire or Contest-related or Sweepstakes-related property or service; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person; or (e) engaging in any conduct that is detrimental or unfair to Dunn Tire, the Contest or Sweepstakes or any other Entrant (in each case as determined in Dunn Tire’s sole discretion). Entries may not include any third-party intellectual property, meaning that any content submitted as part of an entry must not be owned by any third party and must contain only material that originates from the public domain or the Entrant’s original or licensed works.

Winner Selection

Contest and Sweepstakes Winners (“Winners”) are prohibited from winning more than once in a 6-month period. For Contests, Winners will be selected by a representative of Dunn Tire on the basis of qualitative factors described in the initial Tweet/post (i.e., “best/most accurate” response will be selected by a representative of Dunn Tire). For Sweepstakes, Winners will be selected at random, and the odds of winning will be subject to the number of Entrants. Winners will be notified via direct message or email within thirty (30) days of (i) the deadline, which will be stated in the initial Tweet/post, OR (ii) twenty-four (24) hours after the initial Tweet/post’s timestamp if no deadline is stated. After Dunn Tire sends the Entrant a notification that they have won, the Winner has three (3) days to respond via direct message or email with their mailing address and telephone number. P.O. Boxes are not acceptable and will disqualify the Entrant if an alternative mailing address is not provided. Dunn Tire is not responsible for packages that are lost, stolen, or undeliverable. Prizes may require up to 28 days to be delivered.

Prizes

The actual prize (“Prize”) will be pictured or described in the initial Contest or Sweepstakes Tweet/post, but the Prize may be subject to change at any time. Dunn Tire is not responsible for defective items and does not guarantee or warranty any item offered as a Prize. Dunn Tire is not required to honor any requests by Winners to substitute or exchange Prizes. Dunn Tire reserves the right to substitute a Prize of equal or greater value for a Prize or any portion thereof. Certain Prizes may not be assignable or transferable. PRIZES WILL BE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Winners may be required to sign a Declaration of Eligibility, License, and Release which includes a certification of age and residence, acknowledgment and agreement to these Official Rules, license to use the Entrant’s entry, and a release of liability, in order to receive a Contest or Sweepstakes Prize. Winners that do not sign and return the Declaration of Eligibility, License, and Release to us within three (3) days may be subject to disqualification to receive the Prize. If the value of the Prize is more than $500, Winner will also be required to provide Winner’s Social Security number for tax reporting purposes. Permission to Use Entrant’s Name, Image, Likeness and Voice.

By entering the Contest or Sweepstakes, winning Entrants hereby agree to grant to Sponsor, its agents, subsidiaries, affiliates, successors, licensees, and assigns, an exclusive, fully paid, worldwide, perpetual right to use their name, image, likeness, and voice (“Image(s)”), in any media, form, or format now existing or hereinafter created (including, but not limited to, television, radio, cable, video, CD, DVD, MP3, internet, mobile devices, newspapers, or magazines) to publicize Entrant’s selection as the Winner of the Contest or Sweepstakes, without further compensation.

Taxes

All federal, state, and local taxes (including any sales taxes) associated with the receipt or use of a Prize will be the sole responsibility of each Winner. Winners may receive an IRS form 1099 at the end of the calendar year if the value of the Prize is within IRS guidelines, and a copy of such form will be filed with the Internal Revenue Service. Any additional costs relating to the Prize, and incurred as a result of accepting a Prize, are the sole responsibility of each Winner.

Limitations of Liability

Dunn Tire assumes no responsibility for lost, late, incomplete, misdirected, garbled, or unintelligible entries or Tweets, or for theft, destruction, or unauthorized access to, or alteration of, entries. Dunn Tire is not responsible for any incorrect or inaccurate information caused by website users, equipment or programming associated with or utilized in the Contest or Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Contest or Sweepstakes. Dunn Tire assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures, or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. Dunn Tire is not responsible for any injury or damage to Entrants or to any computer equipment related to or resulting from participating or downloading materials in this Contest or Sweepstakes. If the Contest or Sweepstakes is not capable of running as planned, for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Dunn Tire, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest or Sweepstakes, Dunn Tire reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest or Sweepstakes and select Winners from among all eligible entries received prior to the cancellation. Dunn Tire reserves the right to end the Contest or Sweepstakes without fulfillment of Prizes for any reason at any time.

Release of Liability

By entering the Contest or Sweepstakes, all Entrants release Dunn Tire and its affiliated and successor corporations, their directors, officers, shareholders, employees and other agents, professional advisors, advertising, and promotion agencies from all liabilities, claims, and damages arising out of the Entrant’s entry and/or participation in the Contest or Sweepstakes and/or Entrant’s receipt or use of any Prize awarded in the Contest or Sweepstakes.

Indemnity

Entrants agree to indemnify, defend, and hold Dunn Tire harmless from and against any third-party claims arising out of or relating to any breach of any representation, warranty, or covenant made by Entrant in connection with his or her entry into the Contest or Sweepstakes and agreement to these Official Rules.

Privacy

By entering the Contest or Sweepstakes, you agree to Dunn Tire’s use of your personal information as described in Dunn Tire’s Privacy Policy. You can access the Privacy Policy, which provides Entrant with an option to opt-out of receiving information or materials from Dunn Tire. Dunn Tire may provide some of the services to conduct this Contest or Sweepstakes through contractual agreements with affiliates, service providers, and other third parties, who may use your personal information to operate and provide services related to this Contest or Sweepstakes.

Applicable Law

The Contest or Sweepstakes and these Official Rules will be governed, construed, and interpreted under the laws of the State of Arizona. If any provision of these Official Rules is declared to violate any applicable federal, state, or municipal law, all other provisions shall remain in full force and effect.
